Terms of Use

Last updated: October 2024

Provider: gyde GmbH, Rotebühlstraße 50, 70178 Stuttgart, Germany

The gyde platform serves as a continuing education program for executives and employees, focusing on personal development and peer exchange.

1. Access and Registration

Users register with a company email address and a secure password. Google or Apple login options are available if linked to a company email. Users must be at least 18 years old, have full legal capacity, and confirm acceptance of the privacy policy and these Terms of Use. The provider uses a double opt-in procedure for registration verification.

Registration and use of the platform are not guaranteed. Only one registration per person is permitted. Users receive a simple, revocable, non-transferable, non-sublicensable right to use the platform for personal purposes during the user relationship.

2. Services Offered

The platform provides two main components:

  • Microlearning content — delivered via smartphone or web app, including text, quizzes, and reflection tasks
  • Group coaching sessions — conducted bi-weekly via video conference with coaches and participants from other companies

The goal is content delivery, task consolidation, and real-world application through peer discussion.

3. Platform Functions

The platform is available in German and English. After login, users access their profile navigation, course content, and coaching session information, and can work through learning materials.

For questions related to coaching, users may contact the coaching team at coaching@gyde.io.

4. User Obligations

Users must provide truthful information and commit to lawful platform use. Prohibited conduct includes distributing illegal content, material harmful to minors, pornographic content, discriminatory or extremist material, and reverse engineering of the platform.

Users are responsible for all content they post or make accessible on the platform. Passwords must be kept confidential, and suspected unauthorized access must be reported immediately. Users indemnify the provider for damages caused by unauthorized account access or damaging actions.

5. Data Editing

Users can edit their answers to questions, tests, reflection tasks, and notes at any time.

6. Account Deletion

Users may delete their accounts at any time by contacting info@gyde.io. Deletion occurs immediately unless compelling reasons against deletion exist.

7. Rights and Content Ownership

All platform content is protected by copyright or industrial property rights and belongs to the provider, users, or third parties.

Users grant the provider a simple, free, transferable, sublicensable, spatially and temporally unlimited right of use to posted content as necessary for service provision. Users must indemnify the provider if third parties claim rights violations regarding user-posted content.

8. Violation of Terms

The provider may remove illegal content without warning and impose use bans or account deletion for violations. No claim for reimbursement arises from such actions.

9. Personal Data and Data Protection

The provider handles personal data according to German and European data protection law, particularly the GDPR. Users must provide truthful, complete information and report changes immediately to info@gyde.io.

10. Confidentiality of Coaching Conversations

Users must not share business-critical internal information during group coaching. Information exchanged during coaching sessions must be treated confidentially and kept secret from third parties. This obligation continues after contract termination.

11. Availability and Liability

The provider offers no guarantees regarding availability, reliability, and functionality. The provider reserves the right to temporarily restrict services for maintenance and may release updates without prior notice.

Liability exclusions apply except for mandatory Product Liability Act requirements, intent, gross negligence, personal injury, quality guarantees, fraudulent concealment, or essential contractual obligation breaches. Damages for essential contractual obligation breaches are limited to the foreseeable damage typical for the contract unless intent or gross negligence exists.

12. Miscellaneous

German law applies. Stuttgart is the place of jurisdiction for users without a general German jurisdiction. If any provision becomes invalid, the remaining terms remain valid, with invalid provisions replaced by appropriate alternatives.
